Others cannot see eye to eye on major issues involving kids or property, so their cases must go before a judge so decisions can be made on their behalf.

Trials are beneficial when dealing with a difficult spouse

You will only be able to work through challenging negotiations if your former spouse is willing to be reasonable. If there is a lot of resentment about your split or your ex-partner’s views are wildly divergent from yours, you may stand a better chance of winning at trial. For example, if your ex is denying shared custody for invalid reasons, the judge is likely to aware joint custody in the best interest of your child. 

Settling usually takes less time

If your spouse is reasonable and willing to work with you on negotiations, settling might be the better option. This is especially true if you want the process to be wrapped up quickly, as court cases usually take longer to resolve. They also take more of your time, as you will need to prepare evidence for your trial. 

Both options can be stressful

There is no stress-free divorce option. Even if you and your ex-spouse can come to an amicable resolution, you will still experience some stress and anxiety when making decisions. After all, ending a marriage is an emotional experience for everyone, and you want to make decisions in the best interest of you and your family.
